These Terms & Conditions apply when you visit ultimapeak.se or purchase products from UltimaPeak AB. By placing an order, you confirm that you have read and accepted these terms.

Nothing in these terms limits any mandatory consumer rights available to you under applicable law.

ELIGIBILITY

To place an order, you must be legally capable of entering into a binding agreement. If you are under the legal age required in your country, an order must be placed or approved by a parent or legal guardian.

You are responsible for ensuring that the information provided during checkout is accurate and complete.

PRODUCTS

We aim to describe and display our products as accurately as possible. However, colours may appear differently depending on your screen and lighting conditions.

Product weights, measurements and other specifications may vary slightly due to material tolerances and manufacturing processes. These minor variations do not affect your statutory rights if a product is faulty or does not conform to the agreed description.

Unless otherwise stated, products are sold for their intended outdoor and everyday use. You are responsible for reading and following any product instructions, warnings and care information supplied with the product.

PRICES AND CURRENCIES

Prices are displayed in the currency selected for your market. The final price, applicable taxes, shipping charges and any available discounts are shown at checkout before you place your order.

Prices may change without prior notice. A price change will not affect an order that has already been confirmed.

If an obvious pricing or technical error occurs, we may contact you before dispatching the order. You may then choose to proceed at the correct price or cancel the affected item for a full refund.

TAXES, CUSTOMS AND IMPORT FEES

For orders delivered within the European Union, applicable VAT is included where required.

Orders delivered outside the European Union may be subject to import VAT, customs duties, handling charges or other local fees. Unless checkout explicitly states that these charges are included, they are the responsibility of the recipient.

UltimaPeak does not control charges imposed by customs authorities and cannot guarantee their amount. Customers are responsible for complying with applicable import regulations in the destination country.

Refusing delivery or failing to pay import charges does not automatically cancel the order. Any refund may be reduced by reasonable costs incurred in returning the shipment, to the extent permitted by law.

ORDERS

After placing an order, you will receive an order confirmation at the email address provided during checkout. The purchase agreement is formed when we send this confirmation.

We reserve the right to cancel an order before dispatch for legitimate reasons, including:

The product is unavailable
Payment could not be authorised
The delivery address is incomplete or cannot be served
We identify an obvious pricing or product-information error
We reasonably suspect fraud, misuse or an unlawful transaction

If we cancel a paid order, the affected amount will be refunded using the original payment method.

PAYMENT

Available payment methods are shown at checkout and may vary by country or currency.

Payments are processed securely by Shopify and the payment provider selected during checkout. Additional terms from the payment provider may apply.

You confirm that you are authorised to use the selected payment method and that the payment information you provide is accurate.

SHIPPING AND DELIVERY

Available shipping methods, estimated delivery times and shipping charges are displayed at checkout.

Delivery times are estimates and may be affected by customs processing, local carriers, weather, holidays or other circumstances outside our reasonable control. Unless a specific delivery date has been expressly agreed, an estimated delivery time is not a guaranteed delivery date.

You are responsible for providing a complete and accurate delivery address. Contact us as soon as possible if you discover an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

Risk in products purchased by consumers passes to the customer when the order has been physically received by the customer or a person designated by them.

UNCOLLECTED AND UNDELIVERABLE ORDERS

Customers are responsible for collecting orders delivered to a collection point within the period specified by the carrier.

If an order is returned because it was not collected, the address was incorrect or delivery was refused, we may deduct reasonable return-shipping and handling costs from the refund where permitted by law.

An uncollected shipment is not automatically treated as a valid exercise of the right of withdrawal. Please contact us clearly if you wish to cancel or return an order.

RIGHT OF WITHDRAWAL

Consumers in the European Union, European Economic Area and other jurisdictions with equivalent rules generally have the right to withdraw from an online purchase within 14 days without giving a reason.

For goods, the withdrawal period normally begins on the day after you, or a person designated by you, receives the order.

To exercise this right, you must send us a clear statement before the withdrawal period expires. You may contact us by email at gram@ultimapeak.se You may also use the applicable statutory withdrawal form, but this is not required.

After notifying us, you must return the products within 14 days. Unless the product is faulty or we have agreed otherwise, you are responsible for the direct cost of returning it.

You may inspect a product in the same way you reasonably could in a physical shop. We may make a deduction for loss in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and function, where permitted by law.

We will issue the refund within the legally required period. We may withhold reimbursement until we have received the returned products or you have provided evidence that they have been sent back.

The refund will normally be made using the original payment method. Additional delivery costs resulting from your choice of a more expensive shipping method than our least expensive standard option are not refundable where permitted by law.

FAULTY, DAMAGED OR INCORRECT PRODUCTS

Please inspect your order after delivery and contact us as soon as possible if a product is damaged, faulty or incorrect.

Include your order number, a description of the issue and, where helpful, photographs showing the problem. Do not return a faulty product before receiving instructions from us.

Depending on the circumstances and applicable law, available remedies may include repair, replacement, a price reduction or a refund.

Customers purchasing as consumers from UltimaPeak AB have mandatory statutory rights. Under Swedish consumer law, consumers generally have the right to complain about an original defect for up to three years. Any commercial warranty offered by UltimaPeak is additional to these rights and does not replace or restrict them. Swedish Consumer Agency

RETURNS

Returned products should be:

Complete and adequately protected during transport
Returned with included accessories and components
Accompanied by sufficient information to identify the order
Sent according to the return instructions provided by UltimaPeak

You are responsible for the return shipment until it reaches us unless we have arranged or supplied the return service.

Different conditions may apply to faulty products, warranty claims and returns made under mandatory consumer legislation. Please refer to our Refund Policy before returning an item.

PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions stated at the time of the offer.

Unless otherwise stated:

Discount codes cannot be exchanged for cash
Only one discount code may be used per order
Discounts cannot be applied retrospectively
Promotions remain valid only during the stated period
Discount codes may exclude certain products or markets

We may withdraw or correct a promotion if it contains an obvious error or is being misused.

PRODUCT USE AND SAFETY

Products must only be used for their intended purpose and according to any instructions or warnings provided.

Outdoor activities may involve inherent risks. Customers are responsible for selecting equipment appropriate for their experience, environment and intended use, and for inspecting products before use.

This section does not exclude or restrict any liability that cannot legally be excluded, including liability for defective products or personal injury caused by negligence.

INTELLECTUAL PROPERTY

All content on ultimapeak.se, including product names, trademarks, logos, text, photographs, illustrations, graphics, videos, product designs and website content, belongs to UltimaPeak AB or its licensors and is protected by applicable intellectual-property laws.

Content may not be copied, reproduced, modified, distributed or used commercially without prior written permission, except where permitted by law.

ACCEPTABLE USE OF THE WEBSITE

You may not use the website:

For unlawful or fraudulent purposes
To interfere with the website’s operation or security
To transmit malicious code
To collect information about other users without authorisation
To infringe the rights of UltimaPeak or another party
To place fraudulent orders or misuse promotions

We may restrict access or cancel affected orders where reasonably necessary to protect our customers, systems or legal rights.

THIRD-PARTY SERVICES AND LINKS

Our website may contain links to or integrations with third-party services, including payment providers, delivery companies and social-media platforms.

Those services may be governed by their own terms and privacy policies. UltimaPeak is not responsible for third-party websites or services outside our control, except where responsibility cannot legally be excluded.

PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy.

Our store is hosted by Shopify, which provides the ecommerce platform and checkout used to process orders. Relevant payment, delivery and technical service providers may also process information necessary to complete your purchase.

LIABILITY

UltimaPeak is responsible for direct loss caused by our breach of these terms to the extent required by applicable law.

To the fullest extent permitted by law, we are not responsible for indirect or unforeseeable loss, loss caused by misuse of a product, failure to follow instructions or circumstances outside our reasonable control.

Nothing in these terms excludes or limits liability for fraud, gross negligence, death or personal injury caused by negligence, defective products where liability is mandatory, or any other liability that cannot legally be excluded.

If you are purchasing as a consumer, this section does not restrict your mandatory consumer rights.

EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, natural disasters, war, government restrictions, industrial disputes, transport disruption, customs delays, interruption of essential services or failures affecting external providers.

We will take reasonable steps to reduce the effects of such an event and will contact affected customers where appropriate. Mandatory rights relating to cancellation, delivery and refunds remain unaffected.

BUSINESS AND WHOLESALE CUSTOMERS

These Terms & Conditions are primarily intended for retail purchases by consumers.

Wholesale orders, dealer accounts and purchases made on behalf of a business may be governed by separate wholesale terms, quotations or written agreements. If separate terms have been agreed, those terms take precedence in the event of a conflict.

Consumer-specific rights, including the statutory right of withdrawal, do not normally apply to purchases made wholly for business purposes.

GOVERNING LAW

These terms and purchases made from UltimaPeak AB are governed by Swedish law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protection provided by the law of your country of residence.

We encourage you to contact us first so that we can attempt to resolve any issue directly.

SEVERABILITY

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

CHANGES TO THESE TERMS

We may update these Terms & Conditions to reflect changes to our business, services or legal obligations.

The version applicable to your purchase is the version published when your order was placed. The current version and latest update date will always be available on this page.
